    MONITORING OF CONTRACTUAL ARRANGEMENTS

    Conflict-of-interest guidelines

    A conflict of interest arises when a faculty or staff member is in a position to influence the business, research, or other decisions of the University in relationship to an outside organization in ways that could lead directly or indirectly to financial gain for the faculty or staff member or the family of the faculty or staff member, or given improper advantage to others to the detriment of the University.

    Five university policy statements and a State statute are applicable to faculty and staff members in the area of conflict of interest. An overview of these policies can be found in a statement on "Conflict of Interest and Commitment" prepared by the Office of the Vice President for Research and which is available at the following website: (http://www.research.umich.edu/policies/um/coi/index.html). The specific policy statements are as follows:

    1) Section 201.65-1 (http://spg.umich.edu/pdf/201.65-1.pdf) of the University of Michigan Standard Practice Guide is a general policy statement on conflict of interest applicable to all faculty and staff.

    2) Regents’ Bylaw 5.12 (http://www.regents.umich.edu/bylaws/bylaws05b.html#3) governs the permissible outside employment of full-time faculty members.

    3) A policy statement (http://www.provost.umich.edu/faculty/handbook/index.html), published in the Faculty Handbook, specifies a limit on the number of days of outside compensated activity at four days per month.

    4) Section 201.85 (http://spg.umich.edu/pdf/201.85.pdf)of the University of Michigan Standard Practice Guide pertains to the payment of "special stipends" for non-recurring services outside of a staff member’s regular work schedule or assignment, the payment of honoraria, or the payment of moving and travel expenses.

    In addition, the State of Michigan Conflict of Interest Law (Public Act 317 of 1968, as amended by Public Act 81 of 1984) prevents University employees, or enterprises in which they hold a stipulated interest, from contracting with the University without the explicit approval of the Board of Regents.
